Webster (and others) v The Ridgeway School

Following a trial lasting six weeks, involving 52 witnesses and costs of millions of pounds, judgment has been found in favour of Everatt & Company’s client, The Ridgeway School, on all eight points on which liability had been argued. Having highly serious potential implications for other schools and colleges, this case has been followed closely by the national press and the education sector.

An attack on the claimant occurred in January 2007 when Henry Webster, then 15, suffered serious injuries in a fight which took place in the school grounds.  The matter was complicated by the involvement of outside parties, one of whom was responsible for the critical injuries.

A claim was brought against The Ridgeway School, alleging it was negligent and in breach of duty for failing to prevent the attack and/or for creating an environment in which such an attack was likely.  The school was also alleged to have breached Henry Webster’s human rights.

Commenting on behalf of The Ridgeway School, Nick Yates, Senior Partner of Everatt & Company, said:

“The school is greatly saddened that this event occurred, and all the more so that it happened within its grounds.  It does, however, feel vindicated in defeating the suggestion that the event was caused by failures on its part.  Many allegations were made, which were shown to have been without foundation.  The whole process was lengthy and stressful for all parties concerned.”
